The AP reported that Brennan’s lawsuit demands a court order to keep investigation records so they can be used to defend against any eventual indictment on grounds that the case constitutes a vindictive prosecution.

Brennan’s filing says the records would shed light on the motivations of Justice Department officials investigating him, and it argues that without an order the records are at risk of being lost or intentionally deleted.

The lawsuit names as defendants Trump and other top officials including acting Attorney General Todd Blanche, FBI Director Kash Patel, White House chief of staff Susie Wiles and CIA Director John Ratcliffe, along with U.S. attorney Jason Reding Quiñones and special counselor Joe diGenova.

Courthouse News said Brennan brought the case in the U.S. District Court for the District of Columbia and asked U.S. District Judge Jia Cobb to intervene to ensure the Justice Department, the FBI and the U.S. Attorney’s Office for the Southern District of Florida do not destroy relevant internal documents.

“Phantom criminal conduct” claims

Brennan’s lawyers argued that the investigations reflect a preemptive strike and a pattern of politically motivated probes, describing the targeting as “phantom criminal conduct” and saying the Justice Department’s actions amount to “vindictive” prosecution.

The Hill quoted Brennan’s filing saying, “Given these strong indicia of vindictiveness, Director Brennan expects that he will forcefully challenge any eventual indictment,” and it also cited the concern that records may not be preserved until a court can review them.

NBC News reported that Brennan said the records would be essential for him to mount a defense on vindictive prosecution grounds if a future indictment is brought, and it described the lawsuit as demanding a court order to preserve records from investigations into him.

CNN said Brennan asked a federal judge in Washington to order President Donald Trump, Susie Wiles, Todd Blanche, top prosecutors out of Miami, and intelligence community chiefs to preserve their records about Brennan.

The lawsuit frames two separate Justice Department probes, with one centered on allegations that Brennan lied to Congress in 2023 about the U.S. intelligence community’s assessment of Russian interference in the 2016 election and the other described as a “grand conspiracy” probe examining whether Obama- and Biden-era officials were part of a long-running conspiracy to keep Trump out of political office.

AP reported that investigators based in Florida are examining whether Brennan made a false statement to Congress in 2023 related to an assessment documenting Russian interference in the 2016 presidential election, and that another investigation aims to determine whether former law enforcement and intelligence officials conspired to undermine Trump.

Courthouse News added that Brennan said the Justice Department began approaching federal grand juries in the Southern District of Florida in November 2025 and January 2026, and it said a federal grand jury in Washington issued subpoenas on April 18, 2026 that were withdrawn for voluntary interviews.

CBS News said Brennan’s case has been assigned to U.S. District Judge Jia Cobb and that the complaint seeks an order requiring Acting Attorney General Todd Blanche, the Justice Department, and the White House, ODNI and CIA to “preserve materials and communications potentially relevant to Director Brennan’s legal and constitutional challenges to any future criminal charges.”
