A POLITICO Poll found that more than one-third of Americans say it is likely the 2026 midterms will be “stolen,” and one in four say they don’t expect the elections to be fair.

The same POLITICO Poll reported that 58 percent of those who voted for former Vice President Kamala Harris are worried that eligible Americans will be “prevented” from voting, while 52 percent of Trump voters are concerned that some “ineligible” people will be allowed to vote.

POLITICO said the poll asked respondents about 11 election concerns, including partisan gerrymandering and impounding ballots, and found Democrats and Republicans had meaningful disagreement or lacked consensus on six.
Stephen Richer, a legal fellow at the Cato Institute and former Republican county recorder of Maricopa County, Arizona, said, “I don’t think that we have a great working definition of what constitutes … a free and fair election.”
Court fight in Virginia
In Virginia, the Fox News account said the Virginia Supreme Court invalidated a voter-approved redistricting referendum, and Harris accused President Donald Trump and Republicans of trying to “rig” the 2026 midterms.
Harris wrote on X on May 8, “Today, the Virginia Supreme Court ignored the will of the people and overturned those democratically chosen maps,” and she added that the ruling would “give a boost” to Trump’s effort.

Fox News quoted the state’s high court saying, “We hold that the legislative process employed to advance this proposal violated Article XII, Section 1 of the Constitution of Virginia,” and that the violation “nullifies its legal efficacy.”
The measure passed by a narrow 51% to 49% margin and would have temporarily shifted redistricting authority from Virginia’s nonpartisan commission to the Democrat-controlled legislature through 2030, with Fox News saying it was expected to yield a 10-1 Democratic advantage in the state’s congressional delegation.
Accusations and next steps
Fox News said Trump praised the Virginia decision on Truth Social, calling it a “Huge win for the Republican Party, and America, in Virginia,” while Democrats criticized the ruling as putting partisan politics over voters’ will.

Democratic National Committee Chair Ken Martin said “a group of unelected judges on the Virginia Supreme Court chose to put partisan politics over the will of the people,” and Virginia Attorney General Jay Jones said the decision “silences the voices of the millions of Virginians who cast their ballots.”
Fox News reported that Harris wrote, “We are rightfully outraged, but we will not give up. We must continue our fight to restore the power of the people.”
In POLITICO’s polling, White House spokesperson Abigail Jackson said in a statement that President Trump is committed to “totally accurate and up-to-date voter rolls free of errors and unlawfully registered non-citizen voters,” linking the administration’s election confidence message to voter-roll accuracy.
