ESMA targets AI, tokenization
The European Securities and Markets Authority will make AI and tokenization the initial focus of a new supervisory priority on digital innovation starting in 2027. ESMA will coordinate the work through a Union Strategic Supervisory Priority, using it to coordinate national regulators’ work on risks requiring attention across the bloc.
National regulators will map client-facing uses of the technologies, check a subset of firms, and develop common approaches to oversight. Across the European Union, supervisors will identify where tokenization is emerging and document how firms use or plan to use AI and tokenization in products and processes that directly affect investors.

What ESMA will watch
ESMA’s factsheet identifies biased or misleading AI outputs, products investors may struggle to understand, and reliance on a limited number of third-party providers as risks to watch. Supervisors plan to examine what firms tell investors about emerging technologies and share examples of innovations that have improved investor outcomes, reduce bias and ensure reliable results.
ESMA said the priority is intended to help supervisors build expertise and develop common approaches as firms increasingly use AI and tokenized products in financial services. Finance Magnates reported that ESMA’s recent review found that 87% of the 847 AI use cases reported by EU securities firms were for internal activities, while 10% involved customer relationship tools and 3% involved investment services.

Timeline, alongside ESG
ESMA said the new digital innovation priority will run alongside an existing USSP on cyber and operational resilience, launched in 2025. Cointelegraph said ESMA is closing a separate priority on environmental, social and governance disclosures this year.
Finance Magnates said the ESG priority was launched in 2023 and that ESMA has made progress in improving ESG disclosures and helping investors better understand sustainability information and receive quality advice. ESMA framed the USSPs as supervisory convergence tools for addressing high-risk areas of strategic importance across the European Union, directing supervisory resources toward risks that matter most for investor protection, financial stability and the orderly functioning of EU financial markets.
