There were 156,000 outstanding immigration appeals in June, including more than 90,000 asylum cases, almost double the number two years earlier. Meanwhile, legal aid spending on immigration and asylum claims surged 50 per cent, from £39million in 2021/22 to £59million in 2024/25. Reform UK leader Nigel Farage branded the situation “an out of control disaster” and a “massive threat to our national security”. Advertisement Mr Philp also accused Labour of leaving Britain’s borders “wide open” and failing to smash people-smuggling gangs. Among the cases highlighted in The Sun’s investigation was convicted sex offender Jamil Ahmed, who spent almost ten years fighting deportation after serving a jail term for sex offences against underage girls, with legal aid funding his battle to remain in Scotland . The Sun also revealed how Somali migrant Haybe Cabdiraxmaan Nur remained in Home Office accommodation while appealing against the rejection of his asylum claim before going on to murder father-of-three Gurvinder Johal. The cases have fuelled questions over why foreign offenders can remain in Britain for years while taxpayers fund their legal challenges and accommodation. Ameer Kotecha, a former senior Foreign Office diplomat and chief executive of the Centre for Government Reform, called the situation a “parable of broken Britain”. Advertisement He said: “The state is boosting the legal aid budget by almost a third, so asylum seekers are well represented in their defence, then recruiting people who don’t need a legal qualification and don’t yet know immigration law to face them in court. “Lawyers on one side, unqualified learners on the other, and the taxpayer paying for both.” Mr Kotecha said it was extraordinary that legal qualifications or even existing legal knowledge were not essential for a job involving legal arguments and cross-examining appellants three days a week. He warned presenting officers could face experienced solicitors, barristers and specialist advocates while still learning the law. He added: “If the Government is serious about fixing the asylum system, it should make sure the people arguing on its behalf have the legal expertise to do the job — and win.” Advertisement RECOMMENDED STORIES A Home Office spokesman said the Government was increasing removals of foreign national offenders, with nearly 12,000 returned or deported between Labour taking office and the end of March.
