ICC sanctions challenged

A lawsuit filed in New York federal court by Democracy in the Arab World Now (Dawn) and the Taxpayer Alliance Against Genocide (Taag) challenges a February 2025 executive order that placed sanctions on International Criminal Court (ICC) judges, prosecutors and Palestinian human rights groups over claims of human rights violations in the Gaza Strip and the occupied West Bank.

The groups argue the Trump administration is using penalties to illegally "police the political expression of millions of Americans" and suppress pro-Palestinian advocacy, while the White House did not respond to a BBC email seeking comment.

In the same dispute, the BBC reported that Washington previously defended the penalties as necessary to target "illegitimate and baseless actions targeting America and our close ally Israel."

The legal action comes as Secretary of State Marco Rubio suggested the US could expand sanctions and vowed to use "all the tools at our government's disposal" to "dismantle the ICC, brick by brick, if necessary."

Free speech and sovereignty

In a separate framing of the same lawsuit, the Straits Times said the advocacy groups sued on Wednesday arguing that sanctions imposed on the ICC violate constitutional free speech protections after U.S. officials launched a diplomatic campaign aimed at dismantling the court.

Omar Shakir, executive director of Democracy for the Arab World Now, said in a statement that "The Trump administration is using the blunt instrument of economic sanctions not only to punish human rights defenders but to police the political expression of millions of Americans," while the State Department said the lawsuit was "seeking to enable further ICC overreach."

The Guardian reported that the lawsuit alleges the sanctions package has had a "profound" chilling effect on Palestine-related advocacy, compelling Americans to sever professional relationships and abandon constitutionally protected work.

The Guardian also quoted Omar Shakir saying the administration is using "the blunt instrument of economic sanctions not only to punish human rights defenders but to police the political expression of millions of Americans," and it quoted Kenneth Roth warning that it is "blatantly unconstitutional for Trump to threaten American citizens and residents for assisting such efforts."

What comes next

The legal challenge is tied to the ICC’s arrest warrants, with the BBC reporting that the ICC issued an arrest warrant for Benjamin Netanyahu in 2024 over alleged war crimes in Gaza and also issued an arrest warrant for a Hamas commander.

The Al Jazeera report said the sanctions under Trump’s executive order imposed penalties on ICC officials who take part in investigations related to the US and its allies, and it said the lawsuit charges the order "violate Americans' constitutional right to engage in Palestine-related human rights advocacy."

Al Jazeera also said the filing targets sanctions imposed beginning in February 2025 in response to ICC arrest warrants issued for Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant, and it described the executive order as imposing sanctions on the ICC prosecutor and Palestinian human rights groups.

As the campaign escalates, the Free Malaysia Today report quoted Marco Rubio saying the ICC and its allies are waging a war against the US "not with bullets or missiles, but with statutes, compacts and the force of so-called international law," while the State Department official told AFP that the campaign would pressure other countries "to withdraw from the ICC and cut off any financial support to the court."
