Judge blocks deportation

A federal judge blocked deportation of Oscar Belgal after attorneys filed a habeas petition a day after the shooting, and Judge J. Paul Oetken barred the government from deporting him or transferring him outside the Southern District of New York, Eastern District of New York, or the District of New Jersey.

ABC News reported that newly released surveillance footage shows Belgal parked in his SUV when two officers in plainclothes approach him with guns drawn, and the footage shows one of the armed men punching the driver's side window and breaking the glass before Belgal drives off.

The Department of Homeland Security claimed Belgal allegedly "weaponized his vehicle" when ICE agents attempted to arrest him, and DHS said ICE officers were not aware the 5-year-old was in the car during the stop.

New York City Mayor Zohran Mamdani called the incident an "outrage" during a news conference, saying "School had just gotten out. The street was crowded with families and children."

ICE says targeted arrest

The Department of Homeland Security said ICE officers were conducting a "targeted enforcement operation" in the Bronx about 4pm to arrest a 28-year-old Dominican national with a criminal conviction identified as Oscar Belgal by city police. New York Police Commissioner Jessica Tisch said Belgal was pulling into a parking space when a federal officer in plain clothes approached with a gun drawn, and Tisch said at least one of the officers fired seven rounds, hitting the man below his left ear.

Mayor Zohran Mamdani demanded that the agency "must be abolished" and said he would not stand by while ICE agents terrorise communities. DHS Secretary Markwayne Mullin said ICE officers were not aware the 5-year-old was in the car during the car stop, and Mullin blamed Belgal for putting the 5-year-old in that situation.

Protests and investigations

Protests erupted after the shooting, and demonstrators said the incident illustrated the dangers of Trump’s immigration crackdown, with some scuffles with police breaking out. City Council member Carmen De La Rosa said, "We are heartbroken and enraged," and she said the shooting showed ICE operates with impunity.

Governor Kathy Hochul said she urged the halt of ICE enforcement operations in New York and asked that any body camera footage be released to the public. ABC News said a joint FBI and HSI investigation into the shooting was underway, and the report said officers were wearing body-worn cameras and the body-worn cameras were on.
