Beirut hands Issa to Damascus

Lebanese judicial authorities decided on Tuesday to extradite former Assad-era General Adel Isa, ordering his transfer to Syrian authorities for trial on charges tied to crimes committed on Syrian soil.

The Lebanese Special Public Prosecutor for Judicial Disputes, Ahmad Rami Al-Hajj, issued the decision under a Lebanese-Syrian Judicial Agreement signed in 1951, and tasked the Central Criminal Investigation Department with transporting Isa from the Beirut Palace of Justice to the General Directorate of General Security.

The handover is set for the Lebanese-Syrian border, where he will be delivered to a Syrian security committee stationed on the Syrian side of the border, after Isa was questioned by Judge Ahmad Rami Al-Hajj and a detention warrant was issued against him.

Al Jazeera reported that Isa was arrested in Lebanon after embassy staff tipped off authorities when he went to the Syrian embassy in Beirut to do paperwork, and it said the case is part of Syria’s push to pursue former regime members after the fall of Bashar al-Assad in December 2024.

Accusations, denials, and legal test

Al Jazeera quoted judge Mustafa al-Qassem, an aide to the Syrian justice minister, saying, “We are seeking to boost the international judicial cooperation to pursue members of the former regime and extradited to Syria to complete judicial procedures and process,” as it framed Lebanon as no longer a safe haven after Assad’s fall.

The New Arab reported a judicial official as saying Lebanon’s public prosecutor decided to extradite Issa to Syrian authorities to stand trial for “crimes he is accused of committing on Syrian soil,” and added that the file “contains evidence indicating that Issa committed crimes on Syrian territory.”

Anadolu Ajansı said Syrian authorities accuse Issa of murder and crimes against humanity, accusations he has denied, and it described Lebanon’s decision as based on the 1951 agreement.

Al-Jazirah Net said Judge Al-Hajj questioned Isa based on a case file submitted by the Syrian judiciary demanding extradition and issued a detention warrant on suspicion of murder, deliberate and intentional killing, torture resulting in death, and inciting internal and sectarian fighting.

Al-Jazirah Net described the extradition as part of an “unprecedented judicial and political test” in the post-Bashar al-Assad era, with Damascus aiming to recover dozens of former officials and military figures involved in war crimes who fled to Lebanese territory.

It said the case brings legal complexities tied to “international law obstacles related to the death penalty,” while also noting that the Lebanese judiciary’s decision is grounded in the 1951 judicial agreement between Beirut and Damascus.

ANF reported that the Associated Press, citing sources, said elements of the Lebanese General Security Directorate transferred Isa from a detention location in Beirut toward one of the border crossings in preparation for handing him over to the Syrian side.

Oz Arab Media said the extradition raises legal and human rights concerns because Syria still maintains the death penalty, while the Lebanese Parliament has enacted a law abolishing capital punishment, and it quoted Wadie Al-Samir of the Lebanese Center for Human Rights saying Lebanon cannot send a person to a country where they may face the death penalty without violating international and domestic law.
