Sudan sues UAE at ICJ

Sudan filed a case at the International Court of Justice accusing the United Arab Emirates of complicity in genocide, and the ICJ said the filing was made on Wednesday in relation to alleged violations by the UAE of its obligations under the Genocide Convention in relation to the Masalit group in Sudan, most notably in Darfur West. Sudan argued that the UAE’s support for the Rapid Support Forces, a paramilitary group, constituted a violation of the Genocide Convention, and the ICJ said Sudan’s case concerns acts allegedly carried out by the RSF against the Masalit ethnic group that Sudan claims were “facilitated by the direct support provided to the RSF rebel militia and to militiamen associated with the United Arab Emirates.”

The ICJ said Sudan asked for urgent interim orders known as provisional measures on the UAE, including doing all it can to prevent the killing and other crimes targeting the Masalit. The UAE responded by calling Sudan’s filing a “nothing more than a cynical publicity stunt,” and the UAE said it would seek the immediate dismissal of the case.

UAE rejects, Sudan alleges

The BBC said Sudan took the UAE to the ICJ accusing it of supporting Sudan’s paramilitary Rapid Support Forces in the civil war, and Khartoum argued the UAE is “complicit in the genocide” of the Masalit community in West Darfur through military, financial and political backing for the RSF. The BBC reported that Sudan’s submission to the ICJ said, “The United Arab Emirates fuels the rebellion and supports the militia that has committed the crime of genocide in West Darfur.”

The UAE issued a statement asserting the case was a “cynical publicity stunt,” and the UAE said it would seek an immediate dismissal. The AP reported that the UAE statement said the allegations in Sudan’s case “lack any legal or factual basis, representing yet another attempt to distract from this calamitous war,” while the UAE also said the Sudanese Armed Forces’ application to the ICJ does not absolve it from legal and moral responsibility.

Provisional measures and fallout

Sudan asked the ICJ to impose provisional measures so that the UAE take immediate steps to prevent any act of genocide, and Delfino.cr said the requested measures included stopping any form of support to the RSF and other irregular armed groups. Delfino.cr also said Sudan asked the ICJ to prevent the commission of murders, physical and psychological harm, or any action aimed at the complete or partial destruction of the Masalit group, and it said Sudan asked the ICJ to avoid measures that hinder the reproduction of the Masalit community.

The ICJ confirmed receipt of the complaint and would give priority to the request for provisional measures, according to Delfino.cr, while the AP said the case was filed Wednesday and the ICJ announced it Thursday. The AP reported that the war has killed more than 24,000 people and driven over 14 million people, about 30% of the population, from their homes, and it said an estimated 3.2 million Sudanese have escaped to neighboring countries.
